Terms and Conditions of Sale
These general conditions of sale (the “Terms and Conditions”) govern the terms and conditions of sale of the products marketed by Terre Di Puglia (the “Products “).
All contracts for the sale of the Products by Terre di Puglia to third parties (the “Customers”) are governed by these Terms and Conditions, which form an integral and essential part of any proposal, order and order confirmation for the purchase of the Products themselves. The conditions of sale to be applied to orders are those in force on the date of the order.
Products: prices and features
1.1 Unless otherwise stated, the prices of the products published on the website of Terre di Puglia are expressed in Euro and are inclusive of VAT.
The price guaranteed to the buyer is the one published on the Website at the time of the order placement. The price set at the moment of purchase is fixed and final.

The customer is responsible for the choice of the Products ordered.
Orders – billing
Each Product order sent to Terre di Puglia represent the Customer’s contract proposal. The processing of the order by Terre di Puglia means the confirmation and acceptance of the same.
The fiscal documents relating to the Products ordered will be issued by Terre di Puglia at the time of the shipment of the Products to the Customer.
Terre di Puglia will issue an invoice, the Customer must indicate the exact data needed for billing and specify the shipping address of the invoice.
Order execution
The order will be executed according to the terms specified on the Website.
Normally, deliveries are made within 24/48 hours in Italy for all products shown as “available” .
In case of non-execution of the order by Terre di Puglia (if this is due to unavailability of the Products ordered by the Customer), Terre di Puglia will soon inform the customer of the estimated delivery time for the supply of the missing product. If the customer does not intend to wait this time, not exceeding 30 working days, Terre di Puglia srl will refund the amounts, if already paid for the provision not performed.
In case of breakage or depletion of the stock/s or unavailability of the product ordered, Terre di Puglia is committed to inform the customer as soon as possible and provide him with a deadline for availability.
The Customer will confirm his choice by email, i.e. wait for the availability of the Product or claim a refund.
Acceptance of the order
The conclusion of the contract will take place only upon confirmation of the order by Terre di Puglia.
The Customer will receive by fax, mail or e-mail a receipt showing the order confirmation with all the constituent elements of the contract (the ordered products, prices, delivery dates, delivery charges …)
Terre di Puglia reserves the right not to confirm an order for any reason relating in particular to a problem of product supply, or a problem with the order received.
Delivery of products
Products are delivered to the address specified by the customer.
Shipments will be made after payment confirmation: the bank transfer must be attested by a credit on our bank account, while the payment by credit card must be attested by a confirmation of the transaction by the circuit.
For our shipping we rely on the services of qualified couriers such as Bartolini, SDA , UPS, DHL.
Delivery time
Normally, deliveries are made within 24/48 hours in Italy and 3 /4 days for European destinations only for products available in stock. The shipping terms listed on the website, despite being carefully evaluated, are not binding for Terre di Puglia, which can then confirm or change them, depending on its own actual needs. Delivery times are given in working days.
The shipping deadline of an order containing items with different delivery times, is equal to the latest shipping deadline of the articles in order. Any delay in delivery of less than 30 (thirty) days shall not entitle the customer to refuse delivery of the Products, or to claim damages or compensation of any kind.
Terre di Puglia has the right to split, if it deems it appropriate, the delivery of products (even if on the same order) in several successive deliveries.
The delivery is considered as done by the time the product is delivered to the customer.
The delivery document issued by the carrier, dated and signed by the customer upon delivery of the Product, will provide a proof as for transport and release of the goods.
It is important to know that
On delivery, the Customer must verify the content, compliance and status of the Product or Products. Therefore, on delivery, Terre di Puglia recommends that the Customer verifies the state of the Products delivered before signing the acknowledgment , and in particular:
– That the number of packages delivered corresponds to that indicated in the transport document attached to the consignment;
– That the packaging is not damaged, or wet or otherwise altered, and to check the integrity of the content.
If the customer finds abnormalities, he must refuse the delivery of products or write down his reservations, detailed and dated. These reservations must be confirmed with the carrier by registered mail with return receipt within three (3) working days after the delivery of the Products. A copy will be sent to Terre di Puglia.
If the slip is signed without any “reservation”, the customer cannot make any objection on the external characteristics of the delivered package. Any problems concerning the physical integrity, the conformity or completeness of the Products received must be reported within 3 (three) days from delivery.
Terre di Puglia has the right, in its sole discretion, to deliver the products ordered by a carrier of its own choice.
Unless otherwise indicated, all deliveries are made to the road.
Conditions and terms of delivery must be agreed between the Customer and Terre di Puglia and accepted in writing by Terre di Puglia.
Product retrieval in case of absence of the customer
In case of absence of the recipient during delivery, the carrier will leave a notice of passage to the delivery address specified by the customer. The Products must be collected at the address and in the manner specified by the carrier.
In case of failure to withdraw by the deadline set by the carrier, the Products will be returned to Terre di Puglia, which reserves the right to refund the price of the Products , leaving the shipping costs charged to the customer.
In case of wrong product, the Customer agrees to return such Product or Products to Terre di Puglia within 7 (seven) days of receipt, provided that they are returned unopened, in their original packaging and with the accompanying documents.
Once Terre di Puglia receives the Product in the correct form and way, it will send, at its expense, the Product initially ordered.
Force Majeure
Explicitly are considered as cases of force majeure, in addition to those normally considered by the Law, the following cases:
– The total or partial company strikes, internal or external, blocking of means of transport or supply for any reason, legal or governmental restrictions, computer failures, including the blocking of telecommunications networks and of the Internet in particular.
In case of force majeure the execution of the order will be suspended, at first and in full own right.
If after a period of 3 (three) months, the Parties note the persistence of force majeure , the order will be automatically canceled, unless otherwise agreed by both parties.
Right of witdrawal
8.1 Under Article 5 of Legislative Decree no. 185 of 22 May 1999, the Customer (if he can be qualified as a “consumer” within the meaning of Article 1 letter b) of Legislative Decree no. 185 of 22 May 1999) has the right to cancel the contract and return the ordered goods without any penalty and without specifying the reasons within the term of 10 (ten) working days from the receipt of the Products.
8.2 8.2 The right of withdrawal referred to in Article 8.1 shall be exercised by the customer, subject to revocation, by sending a registered letter with return receipt to Terre di Puglia di Nicola Visaggio, Via Barletta 198/e 76123 Andria (BT), within the period of 10 ( ten) working days from the receipt of the Products.
8.3 All returned goods (which must be perfectly intact and accompanied by the original packaging) must be authorized by Customer Service (ldb@terredipuglia.it). Once authorized, the Customer can return the product to the following address: Via Aristofane 27/29 – zona PIP 76123, Andria – BT. Cash on delivery packages will not be accepted.
8.4 Upon receipt of the Products (and once verified their integrity) Terre di Puglia will, as soon as possible, credit the customer the cost of the returned products (as indicated on the invoice), deducting the amount of shipping costs that will be definitively borne by the customer.
8.5 8.5 The right of withdrawal referred to in Article 8.1 cannot be exercised by the Customer in the event that the Products purchased consist in bottles of wine or oil, that have been opened by the Customer or if the items purchased have been ordered and produced specifically upon the customer’s request.
If the goods are damaged during the transport of the goods in return, Terre di Puglia will notify the Customer (within 5 working days of receipt of goods in its stores), in order to allow him to file a timely complaint against the carrier of his choice and get a refund of the value of the property (if insured); in this case, the product will be made available to the customer for the return, simultaneously canceling the request for withdrawal.
Terre di Puglia is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments.
During the withdrawal period referred to in Article 15, the Customer is responsible for the object as a guardian of it. In case of damage or destruction of the product during the customer’s custody, the right of withdrawal will be lost.
Payment
The payment is due at the time of order.
The Customer undertakes to pay the agreed price for the product ordered on the Website (Product price and shipping ) as well as to pay , if necessary, and this directly to the carrier, the VAT or other taxes on import of products in the countries where they will be delivered.
The customer pays the order:
– By credit card, as proposed on the Website
The Customer guarantees Terre di Puglia that he has the necessary authorizations to use the card payment method when ordering.
– Or by bank transfer in favor of Terre di Puglia.
In case of non-receipt by Terre di Puglia of the transfer within 10 days after the order confirmation, Terre di Puglia reserves the right to cancel the order. The bank details are supplied when ordering.

The Customer guarantees to Terre di Puglia that he has the necessary permissions to pay by Paypal when ordering.
Non-payment – Retention of Title
The ordered products remain the property of Terre di Puglia until full payment of their final price (under Article 1523 et seq of the Civil Code). Terre di Puglia reserves the right to reclaim the Products ordered in the event of non-payment.
In this case and at the request of Terre di Puglia, the Customer agrees to return any. Product that has not been paid, at his own expense.
Complaints
Complaints for non-compliance of the Products delivered with the order must be sent in writing directly to the Terre di Puglia, immediately after receiving the goods.
The Customer must keep the original packaging and the delivery document.

Terre di Puglia is the owner of the intellectual property rights of the Website and of the right to disclose the elements that are listed in the catalog of the online store; as a consequence, the total or partial reproduction, on any media, of the elements that make up the Website and catalog, their use as well as their transfer to third parties are strictly forbidden.
Nullity
Should one or more provisions of these terms and conditions were deemed invalid or declared as such under any law, regulation, or following a final decision taken by a competent jurisdiction, the other provisions remain in full force and value.
Jurisdiction
In the event of litigation and in the absence of an amicable agreement reached between the parties, subject to any applicable mandatory provisions of law for the protection of consumers (as defined in article 1 letter b) of Legislative Decree no 185 of 22 May 1999) , any dispute related to these Terms and Conditions shall be referred to the exclusive jurisdiction of the Court of Trani.
